Social \ EB game wont replace DS lite with dead pixel

got this black DS Lite yesterday
when I turned it on there's this red dead pixel on the touch screen
which is very noticeable when playing Metroid prime hunter, Castlevania ect :(

took it back to EB games today and they salesman told me they dont take returns for Nintendo DS Lite and I have to deal directly with Nintendo myself

I thought they has a 'No Fuss 7 Day return or exchage of mechandise with receipt' ?

any comments? thoughts?

On a similar note, I found its better to sell your games at Cash converters rather than at EB. For WPT, Dawn of the dead umd and spidey 2 (umd) EB would only give me $23, none for spidey, but at CC, I got $50!

I traded in some old games + $35 for it so was a good deal

I range two EB stores both said Dead Pixel is not considered faulty

and Nintendo will look at it case by case so I have to send it back myslef

Happened to my psp, they said that you have 2 deal directly 2 sony, it sux

It's actually called the Fair Trading Act.

Agreed, their 7 day policy should indeed cover this, if not this link to the Fair Trading website may be of help.
